Data protection law for employers

As a result of the General Data Protection Regulation (GDPR), which has been in force throughout Europe since 2018, the need for data protection advice has increased massively in recent years. In particular, we offer the preparation of guidelines, declarations of consent and other data protection documents as well as representation before authorities (data protection authority) and courts. We pay particular attention to employee data protection.

 

Data transfer within an (international) corporation, for example, is a tricky area, which can be an issue particularly in the context of frequent group-wide personnel management. In addition, works council powers may be observed in the area of employee data protection and, in particular, works agreements may be necessary. Profiling and automatic decision-making using algorithms in general can play a role in recruiting or evaluating work performance. The questions of whether the company needs a data protection officer and/or a data protection impact assessment or how to deal with data subject rights, such as the right to information in connection with a declaration of consent or a “data breach”, are also of practical relevance.
