
We are pleased that the first part of our article “Maternity protection for board members of a public limited company” has been published in the commercial law sheets (wbl) issue 2/2025 (pages 77-84).
We explain why granting maternity leave of management members is not only possible (as thankfully Brameshuber/Kalss/Maier/Schnittler have already worked out in ZAS2023, 267 ff) is possible under stock corporation law, but is even legally required under European law aspects.
Perhaps the Austrian legislator is reading along? It is urgent time to make the framework conditions for women on the management board of a public limited company up to date.
