Heat Protection Ordinance 2026: Obligations for employers in Austria

The new Heat Protection Ordinance (BGBl II No. 325/2025) has been in effect in Austria since January 1, 2026, and many employers are not yet aware that they need to take action immediately.

This applies to all employers whose employees work outdoors at workplaces, on construction sites, or at off-site locations where they may be exposed to heat or natural UV radiation. This particularly includes employees in construction and related trades, landscaping, logistics, transport, waste management, the events industry, emergency services, facility management, and more. The list is longer than many realize.

The obligation:
An evaluation of heat and UV radiation risks, including a heat protection plan, must now be completed before the next heatwave. As soon as GeoSphere Austria issues a level 2 heat warning (starting at a perceived temperature of 30 °C), the measures defined in the plan must be implemented: specifically, shifting working hours, providing shade, protective equipment, free drinks, and sunscreen. Furthermore, an emergency plan for first aid in the event of heat-related health issues must be in place.

Employers are required to inform their employees about the dangers of heat and natural UV radiation.

If an employer fails to meet these obligations, they face administrative fines of up to €8,324, and up to €16,659 per violation for repeat offenses.
